General terms and conditions of sale for products sold on www.lesgugus.com

ARTICLE 1 - PURPOSE
The present conditions govern sales by the company Les Gugus of handcrafted plush toys.

ARTICLE 2 - PRICES
The prices of our products are indicated in euros, inclusive of all taxes (VAT and other taxes applicable on the date of the order), unless otherwise indicated and exclusive of processing and shipping costs.
In the event of an order to a country other than metropolitan France, you are the importer of the product(s) concerned. Customs duties or other local taxes or import duties or state taxes may be payable. These rights and sums are not the responsibility of Les Gugus. They will be at your expense and are your sole responsibility, both in terms of declarations and payments to the competent authorities and organizations in your country. We advise you to contact your local authorities for further information.
All orders, whatever their origin, are payable in euros.
Les Gugus reserves the right to modify its prices at any time, but the product will be invoiced on the basis of the price list in force at the time of validation of the order and subject to availability.
Products remain the property of Les Gugus until full payment has been received.
Please note: as soon as you take physical possession of the products ordered, the risks of loss or damage to the products are transferred to you.

ARTICLE 3 - ORDERING

Contractual information is presented in French and will be confirmed at the latest when your order is validated.
The company Les Gugus reserves the right not to register a payment, and not to confirm an order in the event of a supply problem, or in the event of difficulty concerning the order received.

ARTICLE 4 - VALIDATING YOUR ORDER
Any order placed on the www.lesgugus.com website implies acceptance of these General Terms and Conditions.
Any confirmation of an order implies your full acceptance of these General Terms and Conditions of Sale, without exception or reservation.
All data supplied and the recorded confirmation shall constitute proof of the transaction.
You declare that you are fully aware of them.
Confirmation of your order will constitute your signature and acceptance of the operations carried out.
Once the Order has been paid for by the Purchaser, the latter will receive confirmation of payment for the Order by e-mail, as well as an acknowledgement of receipt of the Order confirming it and summarizing the elements of the Order, i.e. the description of the Product(s) purchased and the corresponding price, as well as the expected delivery date. The confirmation e-mail also includes a copy of the current General Terms and Conditions of Sale, as well as a mention of the withdrawal period and procedures.
The Purchaser must ensure that the e-mail address given at the time of the Order is correct and that it enables him/her to receive the Order confirmation e-mail.

ARTICLE 5 - PAYMENT
The fact of validating your order implies for you the obligation to pay the indicated price.
Payment is made by credit card using the STRIPE secure system or by PAYPAL.
ARTICLE 6 - RETRACTION
The customer has a period of 14 days from the date of receipt of the Products ordered to cancel the order, without having to give any reason or pay any penalties, with the exception of the cost of returning the Products, which shall be borne by the customer.
If the Customer's Order includes several Products delivered separately, the above-mentioned period runs from receipt of the last Product.
The Customer must then send us the withdrawal form before the expiry of the above period.
We will immediately send the Buyer an acknowledgement of receipt of the withdrawal.

at the latest within 14 days following the communication by the customer of his will to retract.

They must not be washed or handled. They must be accompanied by a copy of the purchase receipt. The customer is deemed responsible for any deterioration of the products when they are returned (in particular traces of slime, deterioration of fabrics, cooking or perfume smells, stains).
The customer will be reimbursed for all sums paid for the order, less the cost of return, which remains at the customer's expense. This reimbursement will be made as soon as possible and at the latest within 14 days of the effective recovery of the products by Les Gugus or until the customer has provided proof of shipment of the products, whichever comes first.
The refund will be made using the same means of payment as that used for the initial transaction, unless the customer and Les Gugus expressly agree in writing to a different means. In any event, this refund will not incur any costs for the customer. We are not obliged to refund any additional costs if the customer has expressly chosen a more expensive delivery method than the standard one offered by us.

ARTICLE 7 - AVAILABILITY
Products are offered for sale while stocks last.
If a product is unavailable after you have placed your order, we will inform you by e-mail. Your order will be automatically cancelled and no bank debit will be made.
ARTICLE 8 - DELIVERY
Deliveries can be made in France and abroad.
Products ordered on the Site are delivered to the delivery address indicated at the time of the Order.
Delivery times are those indicated on the Delivery and Returns page.

ARTICLE 9 - WARRANTY
All our products are covered by the legal guarantee of conformity provided by articles L.217-1 et seq. of the French Consumer Code for goods, and by the guarantee of hidden defects provided by articles 1641 et seq. of the French Civil Code.
In the event of non-conformity of a product sold, it may be returned, exchanged or reimbursed.
All claims, requests for exchange or reimbursement must be made by e-mail to contact.lesgugus@gmail.com within 2 years of delivery of the goods, in accordance with article L.217-3 of the French Consumer Code.
or from the date of the defect, in accordance with article 1648 of the French Civil Code.
Products must be returned in the condition in which you received them, with all accessories, packaging and instructions.
Shipping costs will be reimbursed on the basis of the invoiced rate, and return costs will be reimbursed on presentation of receipts.
The provisions of this Article do not prevent you from benefiting from the right of withdrawal provided for in Article 6.

ARTICLE D. 211-2 OF THE CONSUMER CODE
The consumer has a period of two years from the date of delivery of the good to obtain the implementation of the legal guarantee of conformity in the event of a defect of conformity. During this period, the consumer is only required to establish the existence of the lack of conformity, and not the date of its appearance.
Where the contract for the sale of goods provides for the supply of digital content or a digital service on a continuous basis for a period of more than two years, the legal warranty applies to this digital content or digital service throughout the period of supply. During this period, the consumer is only required to establish the existence of the lack of conformity affecting the digital content or service, and not the date of its appearance.
The legal warranty of conformity requires the professional, where applicable, to provide all updates necessary to maintain the conformity of the good.
The legal warranty of conformity entitles the consumer to repair or replacement of the good within thirty days of his request, free of charge and without any major inconvenience to him.
If the good is repaired under the legal warranty of conformity, the consumer benefits from a six-month extension of the initial warranty.
If the consumer asks for the good to be repaired, but the seller requires it to be replaced, the legal warranty of conformity is renewed for a period of two years from the date of replacement of the good.
The consumer may obtain a reduction in the purchase price by keeping the good, or terminate the contract by obtaining a full refund against return of the good, if :
1° The professional refuses to repair or replace the good;
2° The goods are repaired or replaced after a period of thirty days;
3° The repair or replacement of the good causes a major inconvenience to the consumer, in particular where the consumer definitively bears the cost of taking back or removing the non-conforming good, or if he bears the cost of installing the repaired or replacement good;

4° The non-conformity of the goods persists despite the seller's unsuccessful attempt to bring them into conformity.
The consumer is also entitled to a reduction in the price of the goods or to rescission of the contract where the lack of conformity is so serious as to justify immediate reduction in the price or rescission of the contract. In such cases, the consumer is not obliged to request repair or replacement of the goods beforehand.
The consumer is not entitled to have the sale rescinded if the lack of conformity is minor.
Any period of immobilization of the good with a view to its repair or replacement suspends the warranty which remained in force until the delivery of the reconditioned good.
The rights mentioned above result from the application of articles L. 217-1 to L. 217-32 of the French Consumer Code.
Any seller who obstructs the implementation of the legal warranty of conformity in bad faith is liable to a civil fine of up to 300,000 euros, which may be increased to 10% of average annual sales (article L. 241-5 of the French Consumer Code).
Consumers are also covered by the legal warranty for hidden defects under articles 1641 to 1649 of the French Civil Code, for a period of two years from the discovery of the defect. This warranty entitles the consumer to a price reduction if the good is kept, or to a full refund in exchange for the return of the good.

ARTICLE 10 - LIABILITY
The products offered comply with current French legislation.
Les Gugus shall not be held liable in the event of non-compliance with the legislation of the country where the product is delivered.
It is your responsibility to check with local authorities about the possibility of importing or using the products or services you intend to order.
Furthermore, Les Gugus cannot be held responsible for any damage resulting from misuse of the product purchased.
Finally, the company Les Gugus cannot be held responsible for any inconvenience or damage inherent in the use of the Internet, in particular a break in service, external intrusion or the presence of computer viruses.

ARTICLE 11 - APPLICABLE LAW IN THE EVENT OF DISPUTES
The language of the present contract is French.
The present conditions of sale are subject to French law.
In the event of a dispute, the Buyer has the right to have recourse, free of charge, to a consumer mediator with a view to the amicable resolution of any dispute before the intervention of the competent courts.

The Buyer, if he wishes to have recourse to mediation, must justify having first attempted to resolve his dispute directly with the Seller by means of a written complaint.

ARTICLE 12 - INTELLECTUAL PROPERTY
All elements of the www.lesgugus.com site are and remain the exclusive intellectual property of Les Gugus.
No one is authorized to reproduce, exploit, rebroadcast, or use for any purpose whatsoever, even partially, elements of the site, whether software, visual or sound. Any simple link or hypertext link is strictly forbidden without the written consent of Les Gugus.
ARTICLE 13 - PERSONAL DATA
L'Entreprise Les Gugus reserves the right to collect nominative information and personal data concerning you. This information is required to process your order and to improve the services and information we send you.
It may also be transmitted to companies that contribute to this relationship, such as those responsible for the execution of services and orders for their management, execution, processing and payment.
This information and data is also kept for security purposes, in order to comply with legal and regulatory obligations.
In accordance with the French Data Protection Act of January 6, 1978, you have the right to access, rectify and object to nominative information and personal data concerning you, directly on the website.

ARTICLE 14 - ARCHIVING PROOF
The company Les Gugus will archive order forms and invoices on a reliable and durable medium constituting a faithful copy in accordance with the provisions of article 1348 of the French Civil Code.
